Update: Technology Patents LLC v. Deutsche Telekom AG
The Technology Patents LLC v. Deutsche Telekom AG lawsuit, which was filed in the U.S. District Court for the District of Maryland on Nov. 8, 2007, now has over 400 entries in the court's docket. Motorola and several other defendants filed motions to dismiss, to which Technology Patents has responded. The moving defendants are disputing whether the Court has jurisdiction, and whether the claims of the asserted patents could be infringed by anyone, given that the claims could be construed, in their view, as requiring actions outside the United States (i.e., involving the transmission of text messages between actors in different countries). The parties dispute whether these issues raise questions of fact or are purely legal questions. It will be interesting to see how the Court responds to the motions, the timing of the Court's order, and whether the Court construes the claims to see what they cover before granting or dismissing the motions.
